Please note, that any indication of smoking inside the house or near a room where smoke smell (any type-cigs or weed) can get in the house will result in eviction without question and forfeiture of the security deposit. We are sticklers on this as we worked hard to make this a beautiful building and don't want it stinky. Just please smoke outside away from the doors.

Vacation Rental Terms and Conditions

SECURITY DEPOSIT. In lieu of a security deposit, at the time of the booking, guest shall be required to purchase rental coverage for the duration of their stay. The guest is held financially responsible for damages to the Rental Property, whether made by themselves, their family, and another guest in their group or invitee.

POSSESSION. Guest shall be entitled to possession on the first day of the term of the booking at 3pm (condos) 4pm (houses), and shall yield possession to Manager on the last day of the term of this Booking at 10am, unless otherwise agreed by both parties in writing and early check-in or late check-out fee paid. At the expiration of the booking, guest shall remove its goods and effects and peaceably yield up the Premises to manager in as good a condition as when delivered to guest.

MINIMUM STAY. The guest will be required to pay for the booked dates. Guests wishing to extend their stay may do so by contacting the Manager and paying additional fees if the unit is available for extension and the guest has abided by all rules.

USE OF PREMISES/ABSENCES. Guest shall occupy and use the Premises as a dwelling unit. Guest shall notify Manager of any anticipated extended absence from the Premises not later than the first day of the extended absence. Guest will maintain the premises in good order and appearance including keeping the premises free of trash and garbage. Reasonable wear and tear are the only exceptions to damage to the premises. Booking guest agrees to be the primary occupant of the dwelling during the entire period of the rental.

Guest may not use the premise for commercial or event purposes. No commercial photography or filming is allowed on the property. Guests booking units that may allow small weddings or similar must notify Manager upon booking, pay additional fees and disclose all requested information to Manager. In the event a guest hosts an agreed-upon event but does not give accurate information as to the time of the event, number of guests or type of event, booking will be canceled and guests immediately evicted. Any agreed-upon event must be paid no less than 7 days prior to the event. Manager has the right to deny any event request for any reason.

Guests may not hang towels over outdoor railings, erect tents or banners or do anything else to make property look less appealing to neighbors. Guest agrees to lock all doors and windows when they are not at the property.

Due to the COVID-19 pandemic, Guest agrees to adhere to all guidance from the Centers of Disease Control and Prevention (CDC) on COVID-19 and any local and state regulations. Local and state regulations can be found on the local public health department website.

OCCUPANTS. No more than the number of person(s) entered in the booking may occupy the Premises at any one time unless the prior written consent of the Manager is obtained. All guests over the age of 2 are counted towards the maximum. Any party falsely representing the number of people, or exceeding the maximum may be subject to immediate eviction without refund. All guests over the age of 15 will be required to provide a copy of a government-issued ID.

For properties that allow pets, pets are only allowed if approved by Manager. All pets must be disclosed to Manager within 24 hours of booking, or if booking is less than 24 hours from booking time then at the time of booking. Guest must pay any required pet fees no less than 7 days prior to reservation start. For bookings made within a week of reservation, fee must be paid same day as the reservation is made.

Guests must be 25 to book (or the specified minimum age to book as noted on the booking site). Guests under the minimum age must be accompanied by a legal guardian or parent. Guests over 25 may not book a property for the use of a group under the age of 25 (ex: a mom or aunt cannot book a unit for a group of high schoolers where the parent or legal guardian will not be present).

FURNISHINGS. The unit is completely furnished and stocked. Guest shall return all such items at the end of the stay in a condition as good as existed at the beginning of the booking, normal wear and tear excepted.

PROPERTY INSURANCE. Manager and Guest shall each be responsible to maintain appropriate insurance for their respective interests in the Premises and property located on the Premises. Guest shall also maintain any other insurance which Manager may reasonably require for the protection of Manager's interest in the Premises. Guest is responsible for maintaining casualty insurance on its property. It is recommended that travel or vacation insurance is obtained by the Guest. Manager requires unit insurance coverage purchase at booking.

NON-DISTURBANCE CLAUSE. Guest and their guests shall not disturb, annoy, endanger (fireworks) or inconvenience neighbors nor use the premises for any unlawful purposes. Quiet hours are from 10pm to 8am. Guests shall adhere to noise policy and shall interact kindly with neighbors. Guests understand that many units are in residential areas and will act with the utmost respect while at the premise or in the neighborhood/condo. Guest will not be heard using foul language, being rude, arguing or displaying obvious intoxication.

Guest will treat the property with the same care as if the property was their home and will not hinder normal traffic patterns in the area. Guests will not do anything neither at the unit nor in the neighborhood/building that would cause complaints from neighbors, HOA or Condo Managers or police/code enforcement. Guest will abide by any parking restrictions.

CANCELLATIONS. (a) If the Property becomes unavailable to the Guest prior to occupancy, for any reason, Manager agrees to refund the full amount paid to the date of cancellation, and Guest agrees to rebooking any claims against Manager. (b) Cancellations from guest will be refunded as described on the booking site used by guest. Guest understands that the use of OTA’s such as Airbnb frequently requires the guest contact the OTA directly as sites like Airbnb hold the guest's money and Manager may not have the ability to refund.

Cancellations related to the COVID-19 pandemic are dependent on a number of factors including: local restrictions, origin of the guest, when the booking was made, and when local officials or the CDC declare an outbreak in an area. If the cancellation is related to COVID-19, please refer to the booking site's policy.

SMOKING. Smoking is strictly forbidden inside the Property. Smoking is only allowed "outside". Evidence of smoking inside the Property will result in immediate eviction and forfeiture of all amounts paid and will result in additional Cleaning Fee charges to Guest as Excess Damage Cost and will be charged against the credit card on file. Smoking near open doors and windows that lead to the interior smell of smoke will be charged as if the guest was smoking in the unit. Please note, purchased damage coverage does not cover smoking, and the guest's card on file will be charged $500 for damage and smoke remediation.

COOKING. Guest may cook only in the specific areas set aside by Manager for cooking. No open fires are allowed other than in the grill, outdoor fireplace, or in the stone hearth. The grill must remain in an open area, away from trees, house, etc. All fires must be thoroughly extinguished before leaving unattended.

CLEANING. The property will be inspected and cleaned after departure. Due to the pandemic, the property will augment the current cleaning protocol to account for the changes in cleaning in adherence to COVID-19 cleaning protocols. The cleaning fee includes laundry service for the towels and linens. The guest is required to leave the property in the same general condition that it was received in by making sure that the dishes are washed and put away, and the house is generally picked up and ready to be vacuumed, dusted, disinfected, and laundered. The property has been cleaned in accordance with WHO and CDC recommended cleaning and disinfecting standards.

HOT TUBS & POOLS. For properties with a Hot Tub or Pool, the guest acknowledges, and is fully aware that the hot tub and/or pool can be dangerous and slippery. Injury can be caused by careless acts. The undersigned Guest and their visitors accept and assume all risks involved in or related to the use of the hot tub and/or pool. No lifeguard on duty pool. The guest will be required to never swim alone, and children will always be supervised. Nobody that is unable to swim shall enter the pool or hot tub. No diapers or similar allowed in the pool. No glass or food in the pool. Glass or food in the pool would result in an extra pool cleaning charge to the guest.

HOLDOVER. If Guest maintains possession of the Premises for any period after the termination of this Booking ("Holdover Period”), Guest shall pay to Manager booking payment(s) during the Holdover Period at a rate equal to the most recent highest-posted rate preceding the Holdover Period. Such holdover shall constitute a month-to-month extension of this Booking. Guest is required to prepay and get reapproval to holdover.

CUMULATIVE RIGHTS. The rights of the parties under this Booking are cumulative and shall not be construed as exclusive unless otherwise required by law.

ACCESS BY Manager TO PREMISES. Subject to Guest's consent (which shall not be unreasonably withheld), Manager shall have the right to enter the Premises to make inspections, provide necessary services, or show the unit to prospective buyers, mortgagees, Guests or workers. However, Manager does not assume any liability for the care or supervision of the Premises while under the possession and of Guest. As provided by law, in the case of an emergency, Manager may enter the Premises without Guest's consent. During this Booking, Manager shall be allowed to display the usual "To Let" signs and show the Premises to prospective Guests.

INDEMNITY REGARDING USE OF PREMISES. To the extent permitted by law, Guest agrees to indemnify, hold harmless, and defend Manager from and against any and all losses, claims, liabilities, and expenses, including reasonable attorney fees, if any, which Manager may suffer or incur in connection with Guest's possession, use or misuse of the Premises, except Manager's act or negligence.

DANGEROUS MATERIALS. Guest shall not keep or have on the Premises any article or thing of a dangerous, flammable, or explosive character that might substantially increase the danger of fire on the Premises, or that might be considered hazardous by a responsible insurance company unless the prior written consent of Manager is obtained and proof of adequate insurance protection is provided by Guest to Manager.

COMPLIANCE WITH REGULATIONS. Guest shall promptly comply with all laws, ordinances, requirements, and regulations of the federal, state, county, municipal and other authorities, and the fire insurance underwriters. However, Guest shall not by this provision be required to make alterations to the exterior of the building or alterations of a structural nature.

ASSIGNABILITY/SUBLETTING. Guest may not assign or subbooking any interest in the Premises, nor assign, mortgage or pledge this Booking, without the prior written consent of Manager.

CASUALTY OR DESTRUCTION. (a) Should the Property be destroyed or rendered uninhabitable by an Act of God (including, but not limited to, hurricanes, storms, floods or fires), or by environmental disaster, or loss of utilities prior to occupancy by Guest, this Agreement shall become null and void, and all payments made hereunder shall be refunded to Guest. (b) Should the Property be destroyed or rendered uninhabitable as above during occupancy, reimbursement on a pro-rated basis will be negotiated between Guest and Manager based on the following: No refund is due (or will be made) for inclement weather.

NOTICE. Notices under this Booking shall not be deemed valid unless given or served in writing and forwarded by mail, postage prepaid, addressed to the party at the appropriate address set forth below. Such addresses may be changed from time to time by either party by providing notice as set forth below. Notices mailed in accordance with these provisions shall be deemed received on the third day after posting.

GOVERNING LAW. This Booking shall be construed in accordance with the laws of the State of Florida.

ENTIRE AGREEMENT/AMENDMENT. This Booking contains the entire agreement of the parties and there are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this Booking. This Booking may be modified or amended in writing if the writing is signed by the party obligated under the amendment.

SEVERABILITY. If any portion of this Booking shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Booking is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

WAIVER. The failure of either party to enforce any provisions of this Booking shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Booking.

BINDING EFFECT. The provisions of this Booking shall be binding upon and inure to the benefit of both parties and their respective legal representatives, successors, and assigns.

DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure.

Any controversies or disputes arising out of or relating to this Agreement will be submitted to mediation in accordance with any statutory rules of mediation. If mediation is not successful in resolving the entire dispute or is unavailable, any outstanding issues will be submitted to final and binding arbitration under the rules of the American Arbitration Association. The arbitrator's award will be final, and judgment may be entered upon it by any court having proper jurisdiction.

CAUSE FOR EVICTION. The Guest and all parties with the Guest will be subject to immediate eviction from the Property if the Guest or parties of the Guest violate any terms of this Agreement, including but not limited to, violation of the occupancy limits, pet provision, smoking, noise ordinance or parking. In the event of eviction from the Property, the Guest shall forfeit all amounts paid and there will be no refund of money.

ATTORNEY'S FEES AND COSTS. If Manager employs the services of an attorney to enforce any conditions of this Agreement, to collect any amounts due, the eviction of the Guest, or because Guest takes any action to recover deposits not due, Guest shall be liable to Manager for reasonable attorney's fees and costs incurred by Manager.

Renter must be at least 21 years of age (or the specified minimum age required to rent the property if different). Guests under the minimum age must be accompanied by a parent or legal guardian.
